1.1          A bill for an act
1.2          relating to education; allowing school districts to donate surplus schoolbooks;
1.3          amending Minnesota Statutes 2024, section 123B.52, by adding a subdivision.
1.4          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5          Section 1. Minnesota Statutes 2024, section 123B.52, is amended by adding a subdivision
1.6          to read:
1.7                          Subd. 6a.Disposing of surplus books. Notwithstanding section 471.345, governing
1.8          school district contracts made upon sealed bid or otherwise complying with the requirements
1.9          for competitive bidding, other provisions of this section governing school district contracts,
1.10       or other law to the contrary, a school district under this subdivision may dispose of
1.11       schoolbooks, including library books, books from an individual classroom library, and
1.12       textbooks including other materials accompanying a textbook. A school district may dispose
1.13       of surplus books by donating them to a charitable organization under section 501(c)(3) of
1.14       the Internal Revenue Code that is registered with the attorney general's office for educational
1.15       use.
