1.1 A bill for an act
1.2 relating to education; requiring cardiac emergency response plans; appropriating
1.3 money;amending Minnesota Statutes 2024, section 128C.02, by adding a
1.4 subdivision; proposing coding for new law in Minnesota Statutes, chapter 121A.
1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [121A.241] CARDIAC EMERGENCY RESPONSE PLAN.
1.7 Subdivision 1.Cardiac emergency response plan. (a) For purposes of this section, a
1.8 "cardiac emergency response plan" is a written document that establishes specific steps to
1.9 reduce death from cardiac arrest. A cardiac emergency response plan must integrate
1.10 evidence-based core elements, such as those recommended by the American Heart
1.11 Association in accordance with a published, peer-reviewed journal article or similar
1.12 document.
1.13 (b) Beginning in the 2026-2027 school year, a school district or charter school must
1.14 develop a cardiac emergency response plan that addresses the appropriate use of school
1.15 personnel to respond to incidents involving an individual experiencing sudden cardiac arrest
1.16 or a similar life-threatening emergency while on school grounds or at a school-sponsored
1.17 activity or event. A district or charter school must consult with athletic trainers when
1.18 developing the plan. A principal or other person having administrative control over the
1.19 school site must ensure that the plan is:
1.20 (1) available to the school community on the school website and in paper form at various
1.21 locations at the school site;
1.22 (2) distributed to all coaches and other athletic staff members at each school site, all
1.23 persons responsible for executing the plan in the event of a cardiac emergency, all health
2.1 care professionals that provide medical services during school-sponsored activities or events,
2.2 and to other appropriate school staff, as determined by school administrators; and
2.3 (3) annually reviewed, rehearsed, and revised, as necessary.
2.4 (c) A cardiac emergency response plan must:
2.5 (1) identify the members of a cardiac emergency response team at each school site who
2.6 are on duty during the regular school day;
2.7 (2) provide guidelines for the cardiac emergency response team's response to sudden
2.8 cardiac arrest;
2.9 (3) require that automatic external defibrillators are clearly marked and placed in
2.10 accordance with guidelines from the American Heart Association or other nationally
2.11 recognized guidelines focused on emergency cardiovascular care. Automatic external
2.12 defibrillators must be available for use in an unlocked location at each school facility and
2.13 athletic venue or event. Automatic external defibrillators must be (i) easily accessible at
2.14 each athletic venue where practices or competitions are held or (ii) located within one to
2.15 three minutes of each venue where practices or competitions are held;
2.16 (4) require training on cardiopulmonary resuscitation and automatic external defibrillator
2.17 use for coaches, assistant coaches, and other school staff identified by school administrators;
2.18 (5) require the emergency response team to participate in a cardiac emergency simulation
2.19 at least 30 days before the beginning of each school year;
2.20 (6) describe the procedures that must be followed after a serious or life-threatening injury
2.21 or cardiac emergency occurs at an athletic event or activity, including but not limited to
2.22 responding to the injured individual, summoning emergency medical care, assisting
2.23 emergency medical service providers, and documenting the actions taken during the
2.24 emergency; and
2.25 (7) encourage cooperation and coordination with community members such as emergency
2.26 medical technicians and paramedics, among others.
2.27 Subd. 2.Training requirements. (a) A school district or charter school must provide
2.28 all members of a cardiac emergency response team with training necessary to implement a
2.29 cardiac emergency response plan.
2.30 (b) The emergency response team must provide annual certification to the school board
2.31 that members of the emergency response team completed cardiac emergency simulation
2.32 training at least 30 days prior to the beginning of each school year.
3.1 Sec. 2. Minnesota Statutes 2024, section 128C.02, is amended by adding a subdivision to
3.2 read:
3.3 Subd. 3d.Cardiac emergency response plan. The league must adopt a cardiac
3.4 emergency response plan that meets the requirements of section 121A.241. The league must
3.5 ensure that a cardiac emergency response team is present at each interscholastic athletic
3.6 activity whose control, supervision, and regulation have been delegated to the Minnesota
3.7 State High School League in accordance with section 128C.01.
3.8 Sec. 3. APPROPRIATION; CARDIAC EMERGENCY RESPONSE PLAN
3.9 ASSISTANCE.
3.10 Subdivision 1.Department of Education. The sum indicated in this section is
3.11 appropriated from the general fund to the Department of Education in the fiscal year
3.12 designated.
3.13 Subd. 2.Cardiac emergency response plan assistance. (a) To assist school districts
3.14 and charter schools implementing cardiac emergency response plans under Minnesota
3.15 Statutes, section 121A.241:

3.17 (b) Funding may be used for activities and equipment that promote cardiac emergency
3.18 response plan preparedness in schools, including but not limited to the purchase and
3.19 maintenance of automatic external defibrillators, purchase of cardiopulmonary resuscitation
3.20 equipment and training for faculty and staff, basic first aid training, and educational materials
3.21 related to cardiac emergency response preparedness.
3.22 (c) This is a onetime appropriation and is available until June 30, 2027.
