I chose HF283, introduced by Rep. Tom Sexton. This bill clarifies the language in Minnesota statute 609.065, expands what is considered self defense, and eliminates the “duty to retreat” inside of someone's own residence. This would protect people who use deadly force against home invaders from prosecution. I think this bill is important to make sure that citizens are not being unfairly prosecuted for defending themselves or their homes.
The pros of this bill are that it provides clearer guidelines on use of force in self defense situations, reduces ambiguity, eliminates duty to retreat, which could save lives in high pressure situations. The bill also expands the definition of a dwelling to include porches and garages, creates a presumption or reasonable fear in the event of a break in, and clarifies that self defense rights extend to the defense of others, which would protect good samaritans. This would align Minnesota's self defense laws with those of many other states, as they are currently the strictest in the nation.
Some cons of the bill are that looser self defense laws have been linked to an increase in homicide, although the vast majority of the increase is considered justifiable homicide. The standard of fear could also be seen as more subjective, and it might be harder to prosecute in situations where force, but not lethal force, was justified.
