1.1          A bill for an act
1.2          relating to sports betting; proposing an amendment to the Minnesota Constitution
1.3          by adding a section to article XIII; authorizing sports betting if conducted by a
1.4          horse racing track or Indian Tribe; requiring a certain tax to be imposed on sports
1.5          betting.
1.6          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7          Section 1. CONSTITUTIONAL AMENDMENT PROPOSED.
 1.8        An amendment to the Minnesota Constitution is proposed to the people. If the amendment
1.9          is adopted, a section shall be added to article XIII, to read:

1.10       Sec. 13. Sports betting is not prohibited in this state, provided that organized,
1.11       commercialized, or systematic sports betting may only be conducted by a federally recognized
1.12       Indian Tribe conducting class III gaming under a Tribal-state gaming compact or a racetrack
1.13       licensed by the state to conduct pari-mutuel horse racing. Sports betting may only be
1.14       conducted as provided by law and the legislature must timely enact a system of regulation
1.15       for the conduct of sports betting. A tax on sports betting must be imposed by law at a rate
1.16       of 20 percent on the amounts wagered, less the winnings paid to individuals placing wagers.
1.17       The legislature must appropriate revenues from the tax in equal shares to fund substance
1.18       use disorder programs, local charitable organizations funded by donations from licensed
1.19       lawful gambling organizations, pari-mutuel horse racing purses, and the state general fund.

1.20       Sec. 2. SUBMISSION TO VOTERS.
 1.21      The proposed amendment must be submitted to the people at the 2026 general election.
1.22       The question submitted must be:
2.1          "Shall the Minnesota Constitution be amended to legalize sports betting only if conducted
2.2          by an Indian Tribe in Minnesota or horse racing track, to tax sports betting, and to use the
2.3          tax revenue to fund substance use disorder programs, local charitable organizations, horse
2.4          racing purses, and the state general fund?
