1.1 A bill for an act
1.2 relating to transportation; authorizing electric vehicle infrastructure program;
1.3 proposing coding for new law in Minnesota Statutes, chapter 174.
1.4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. [174.47] ELECTRIC VEHICLE INFRASTRUCTURE PROGRAM.
1.6 Subdivision 1.Definitions. (a) For purposes of this section, the following terms have
1.7 the meanings given.
1.8 (b) "Commissioner" means the commissioner of transportation.
1.9 (c) "Program" means the electric vehicle infrastructure program established in this
1.10 section.
1.11 (d) "Project" includes but is not limited to planning, predesign, design, preliminary and
1.12 final engineering, environmental analysis, property acquisition, construction, and
1.13 maintenance.
1.14 Subd. 2.Electric vehicle infrastructure program. The commissioner of transportation
1.15 must establish a statewide electric vehicle infrastructure program for the purpose of
1.16 implementing the National Electric Vehicle Infrastructure Formula Program and successor
1.17 programs to maximize the use of federal funds available to the state.
1.18 Subd. 3.Authority to contract. The commissioner may enter into an agreement with
1.19 any private or public entity to provide financial assistance for, or engage in the planning,
1.20 designing, developing, hosting, constructing, equipping, operating, or maintaining of, electric
1.21 vehicle infrastructure, including but not limited to environmental studies, preliminary
1.22 engineering, final design, construction, and developing financial and operating plans.
2.1 Subd. 4.Program requirements. (a) The commissioner must require that electric vehicle
2.2 infrastructure funded under the program is constructed, installed, and maintained in
2.3 conformance with the requirements under Code of Federal Regulations, title 23, section
2.4 680.106, paragraph (j), or successor requirements.
2.5 (b) An electric vehicle infrastructure project that receives funds under the program is
2.6 subject to the requirement of paying the prevailing wage rate as defined in section 177.42,
2.7 and the requirements and enforcement provisions in sections 177.27, 177.30, 177.32, 177.41
2.8 to 177.435, and 177.45.
