1.1 A bill for an act
1.2 relating to health;
establishing requirements for the use of hot water pools on
1.3 certain rental
properties;amending Minnesota Statutes 2024, section 144.1222,
1.4 subdivision 2d.
1.5 BE IT ENACTED BY THE
LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes
2024, section 144.1222, subdivision 2d, is amended to read:
1.7 Subd. 2d.Hot
tubs on rental houseboats property. (a) Except as provided
in paragraph
1.8 (b), a hot water
pool intended for seated recreational use, including a hot tub or whirlpool,
1.9 that is located on a
houseboat that is rented to the public the property of a stand-alone,
1.10 single-unit rental
property, offered for rent by the property owner or through a resort, and
1.11 that is only intended to
be used by the occupants of the rental property:
1.12 (1) is not a public
pool and;
1.13 (2) is exempt from
the requirements for public pools under subdivisions 1 to 2c, 4, and
1.14 5 and Minnesota
Rules, chapter 4717, except as otherwise provided in this paragraph; and
1.15 (3) may be used by
renters so long as:
1.16 (i) the water
temperature in the hot water pool does not exceed 106 degrees Fahrenheit;
1.17 (ii) prior to check-in
by each new rental party, the resort or property owner tests the
1.18 water in the hot water
pool for the concentration of chlorine or bromine, pH, and alkalinity,
1.19 and the water in the hot
water pool meets the requirements for disinfection residue, pH, and
1.20 alkalinity in Minnesota
Rules, part 4717.1750, subparts 4, 5, and 6; and
2.1 (iii) upon rental, the
resort or property owner provides renters with a notice that there
2.2 is a hot water pool on
the property and that the hot water pool is not subject to all of the
2.3 requirements in state
law and rules for public pools.
2.4 (b) A hot water pool
intended for seated recreational use, including a hot tub or whirlpool,
2.5 that is located on a
houseboat that is rented to the public:
2.6 (1) is not a public
pool;
2.7 (2) is exempt from the
requirements for public pools under subdivisions 1 to 2c, 4, and
2.8 5 and Minnesota Rules,
chapter 4717; and
2.9 (3) is exempt from the
requirements under paragraph (a), clause (3).
2.10 (c) A political
subdivision must not adopt a local law, rule, or ordinance that prohibits
2.11 the operation of, or
establishes additional requirements for, a hot water pool that meets the
2.12 criteria in paragraph
(a) or (b).
2.13 (d) A hot water pool
under this subdivision must be conspicuously posted with the
2.14 following notice to renters:
2.15 "NOTICE
2.16 This spa is exempt from certain
state and local sanitary requirements that prevent disease
2.17 transmission.
2.18 USE AT YOUR OWN RISK
2.19 This notice is required under
Minnesota Statutes, section 144.1222, subdivision 2d."
