1.1          A bill for an act
1.2          relating to education; protecting access to culturally inclusive learning
1.3          environments;proposing coding for new law in Minnesota Statutes, chapter 121A.
1.4          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5          Section 1. [121A.09] ACCESS TO CULTURALLY INCLUSIVE LEARNING
1.6          ENVIRONMENTS PROTECTED.
1.7                          Subdivision 1.Access to culturally inclusive learning environments. A school district
1.8          must not ban, remove, or otherwise restrict culturally relevant resources and displays in
1.9          educational environments on the sole basis of viewpoint or the messages, ideas, or opinions
1.10       they convey.
1.11                       Subd. 2.Definitions. (a) For purposes of this section, the terms defined in this subdivision
1.12       have the meanings given.
1.13       (b) "Culturally relevant resources" means noncurricular materials in classroom spaces
1.14       that contribute to or reflect the diversity of student and community cultures.
1.15       (c) "District" means a district under section 120A.05, subdivision 8, and includes a
1.16       charter school under chapter 124E.
1.17       (d) "School board" means the board with authority to govern, manage, and control the
1.18       schools in the district.
1.19                       Subd. 3.Limitations. (a) Nothing in this section limits a school board's authority to
1.20       decline to purchase, distribute, or display materials legitimately based upon:
1.21       (1) practical reasons, including but not limited to space limitations;
2.1          (2) legitimate pedagogical concerns, including but not limited to the appropriateness of
2.2          potentially sensitive topics for the school's intended audience or the likelihood of causing
2.3          a material and substantial disruption of the work and discipline of the school; or
2.4          (3) compliance with state or federal law.
2.5          (b) Nothing in this section impairs or limits the rights of a parent, guardian, or an adult
2.6          student to review instructional materials under section 120B.20.
2.7                          Subd. 4.Discrimination prohibited. A school board may not discriminate against or
2.8          discipline an employee for complying with this section.

2.9          EFFECTIVE DATE. This section is effective July 1, 2025.
