1.1          A bill for an act
1.2          proposing an amendment to the Minnesota Constitution, article I, section 10;
1.3          providing that the right of citizens to be secure from unreasonable searches and
1.4          seizures includes protection against unreasonable searches and seizures of electronic
1.5          communications and data.
1.6          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7          Section 1. CONSTITUTIONAL AMENDMENT PROPOSED.
 1.8        An amendment to the Minnesota Constitution is proposed to the people. If the amendment
1.9          is adopted, article I, section 10, will read:

1.10       Sec. 10. The right of the people to be secure in their persons, houses, papers, and effects,
1.11       and in their electronic communications and data, against unreasonable searches and seizures
1.12       shall not be violated; and no warrant shall issue but upon probable cause, supported by oath
1.13       or affirmation, and particularly describing the place to be searched and, the person or things
1.14       to be seized, and the electronic communications or data to be accessed.

1.15       Sec. 2. SUBMISSION TO VOTERS.
 1.16      The proposed amendment must be submitted to the people at the 2026 general election.
1.17       The question submitted must be:
1.18       "Shall the Minnesota Constitution be amended so that the people are secure in their
1.19       electronic communications and data from unreasonable searches and seizures as they are
1.20       now likewise secure in their persons, homes, papers, and effects?
