1.1 A bill for an act
1.2 relating to commerce; modifying requirements for entities offering biodegradable
1.3 or compostable products;amending Minnesota Statutes 2024, section 325E.046,
1.4 subdivision 2a.
1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2024, section 325E.046, subdivision 2a, is amended to read:
1.7 Subd. 2a.Certification of products. Beginning January 1, 2026, A manufacturer,
1.8 distributor, or wholesaler may not sell or offer for sale and any other person may not
1.9 knowingly sell or offer for sale in this state a covered product labeled as "biodegradable"
1.10 or "compostable" unless the covered product is certified as meeting the requirements of
1.11 subdivision 1 or 2, as applicable, by an entity that:
1.12 (1) is a nonprofit corporation;
1.13 (2) as its primary focus of operation, (1) promotes the production, use, and appropriate
1.14 end of life for materials and products that are designed to fully biodegrade in specific
1.15 biologically active environments such as industrial composting; and
1.16 (3) (2) is technically capable of and willing to perform analysis necessary to determine
1.17 a product's compliance with subdivision 1 or 2, as applicable.
1.18 EFFECTIVE DATE. This section is effective the day following final enactment.
