1.1 A bill for an act
1.2 relating to education; requiring a personal finance class for high school graduation;
1.3 establishing a personal finance seal for teacher licensure; authorizing rulemaking;
1.4 amending Minnesota Statutes 2022, sections 120B.021, subdivision 1; 120B.024,
1.5 subdivision 1; 122A.09, subdivision 9; proposing coding for new law in Minnesota
1.6 Statutes, chapter 122A.
1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.8 Section 1. Minnesota Statutes 2022, section 120B.021, subdivision 1, is amended to read:
1.9 Subdivision 1.Required academic standards. (a) The following subject areas are
1.10 required for statewide accountability:
1.11 (1) language arts;
1.12 (2) mathematics;
1.13 (3) science;
1.14 (4) social studies, including history, geography, economics, and government and
1.15 citizenship that includes civics consistent with section 120B.02, subdivision 3;
1.16 (5) physical education;
1.17 (6) health, for which locally developed academic standards apply; and
1.18 (7) the arts, for which statewide or locally developed academic standards apply, as
1.19 determined by the school district. Public elementary and middle schools must offer at least
1.20 three and require at least two of the following four arts areas: dance; music; theater; and
1.21 visual arts. Public high schools must offer at least three and require at least one of the
1.22 following five arts areas: media arts; dance; music; theater; and visual arts.; and
2.1 (8) personal finance.
2.2 (b) For purposes of applicable federal law, the academic standards for language arts,
2.3 mathematics, and science apply to all public school students, except the very few students
2.4 with extreme cognitive or physical impairments for whom an individualized education
2.5 program team has determined that the required academic standards are inappropriate. An
2.6 individualized education program team that makes this determination must establish
2.7 alternative standards.
2.8 (c) The department must adopt the most recent SHAPE America (Society of Health and
2.9 Physical Educators) kindergarten through grade 12 standards and benchmarks for physical
2.10 education as the required physical education academic standards. The department may
2.11 modify and adapt the national standards to accommodate state interest. The modification
2.12 and adaptations must maintain the purpose and integrity of the national standards. The
2.13 department must make available sample assessments, which school districts may use as an
2.14 alternative to local assessments, to assess students' mastery of the physical education
2.15 standards beginning in the 2018-2019 school year.
2.16 (d) A school district may include child sexual abuse prevention instruction in a health
2.17 curriculum, consistent with paragraph (a), clause (6). Child sexual abuse prevention
2.18 instruction may include age-appropriate instruction on recognizing sexual abuse and assault,
2.19 boundary violations, and ways offenders groom or desensitize victims, as well as strategies
2.20 to promote disclosure, reduce self-blame, and mobilize bystanders. A school district may
2.21 provide instruction under this paragraph in a variety of ways, including at an annual assembly
2.22 or classroom presentation. A school district may also provide parents information on the
2.23 warning signs of child sexual abuse and available resources.
2.24 (e) District efforts to develop, implement, or improve instruction or curriculum as a
2.25 result of the provisions of this section must be consistent with sections 120B.10, 120B.11,
2.26 and 120B.20.
2.27 (f) The department must adopt the most recent national standards for personal finance
2.28 adopted by the Jump$tart Coalition and the Council for Economic Education.
2.29 EFFECTIVE DATE. This section is effective the day following final enactment.
2.30 Sec. 2. Minnesota Statutes 2022, section 120B.024, subdivision 1, is amended to read:
2.31 Subdivision 1.Graduation requirements. (a) Students beginning 9th grade in the
2.32 2011-2012 school year and later must successfully complete the following high school level
2.33 credits for graduation:
3.1 (1) four credits of language arts sufficient to satisfy all of the academic standards in
3.2 English language arts;
3.3 (2) three credits of mathematics, including an algebra II credit or its equivalent, sufficient
3.4 to satisfy all of the academic standards in mathematics;
3.5 (3) an algebra I credit by the end of 8th grade sufficient to satisfy all of the 8th grade
3.6 standards in mathematics;
3.7 (4) three credits of science, including at least one credit of biology, one credit of chemistry
3.8 or physics, and one elective credit of science. The combination of credits under this clause
3.9 must be sufficient to satisfy (i) all of the academic standards in either chemistry or physics
3.10 and (ii) all other academic standards in science;
3.11 (5) three and one-half credits of social studies, encompassing at least United States
3.12 history, geography, government and citizenship, world history, and economics sufficient
3.13 to satisfy all of the academic standards in social studies;
3.14 (6) one credit of the arts sufficient to satisfy all of the state or local academic standards
3.15 in the arts; and
3.16 (7) a minimum of seven elective credits.
3.17 (b) A school district is encouraged to offer a course for credit in government and
3.18 citizenship to 11th or 12th grade students who begin 9th grade in the 2020-2021 school year
3.19 and later, that satisfies the government and citizenship requirement in paragraph (a), clause
3.20 (5).
3.21 (c) Students who begin 9th grade in the 2024-2025 school year and later must successfully
3.22 complete a half-credit in personal finance sufficient to satisfy all of the academic standards
3.23 in personal finance. A student may choose to have the half-credit replace an elective
3.24 half-credit or algebra II math half-credit. A teacher of a personal finance course that satisfies
3.25 the graduation requirement, if the half-credit replaces an elective or algebra II math
3.26 half-credit, must:
3.27 (1) have a teaching license in agricultural education, business, family and consumer
3.28 science, social studies, or math, and satisfy the requirements under section 122A.265; or
3.29 (2) have a teaching license, have an out-of-field permission, and meet the requirements
3.30 for a seal under section 122A.265.
3.31 EFFECTIVE DATE. This section is effective July 1, 2023.
4.1 Sec. 3. Minnesota Statutes 2022, section 122A.09, subdivision 9, is amended to read:
4.2 Subd. 9.Professional Educator Licensing and Standards Board must adopt rules. (a)
4.3 The Professional Educator Licensing and Standards Board must adopt rules subject to the
4.4 provisions of chapter 14 to implement sections 120B.363, 122A.05 to 122A.09, 122A.092,
4.5 122A.16, 122A.17, 122A.18, 122A.181, 122A.182, 122A.183, 122A.184, 122A.185,
4.6 122A.187, 122A.188, 122A.20, 122A.21, 122A.23, 122A.26, 122A.265,122A.28, and
4.7 122A.29.
4.8 (b) The board must adopt rules relating to fields of licensure, including a process for
4.9 granting permission to a licensed teacher to teach in a field that is different from the teacher's
4.10 field of licensure without change to the teacher's license tier level.
4.11 (c) The board must adopt rules relating to the grade levels that a licensed teacher may
4.12 teach.
4.13 (d) If a rule adopted by the board is in conflict with a session law or statute, the law or
4.14 statute prevails. Terms adopted in rule must be clearly defined and must not be construed
4.15 to conflict with terms adopted in statute or session law.
4.16 (e) The board must include a description of a proposed rule's probable effect on teacher
4.17 supply and demand in the board's statement of need and reasonableness under section 14.131.
4.18 (f) The board must adopt rules only under the specific statutory authority.
4.19 EFFECTIVE DATE. This section is effective the day following final enactment.
4.20 Sec. 4. [122A.265] PERSONAL FINANCE SEAL.
4.21 (a) The Professional Educator Licensing and Standards Board must adopt rules
4.22 establishing a personal finance seal for teachers that hold a teaching license issued under
4.23 this chapter. The rules must require a teacher to provide evidence that:
4.24 (1) the teacher prepared for teaching a personal finance course when completing a teacher
4.25 preparation program and taught the course in the previous five years; or
4.26 (2) passed an approved certification program or test listed under paragraph (c).
4.27 (b) The board may identify in rule additional eligible programs or test that a candidate
4.28 may complete or pass to obtain the seal.
4.29 (c) A teacher may satisfy the training requirements for the seal by providing evidence
4.30 that the teacher:
5.1 (1) completed a course in personal or consumer finance as part of the teacher's teacher
5.2 preparation program and taught a personal finance course in the previous five years;
5.3 (2) completed a certification course equivalent to 40 to 50 hours offered by the Minnesota
5.4 Council on Economic Education, or collaboratively by the Minnesota Council on Economic
5.5 Education and Next Gen Personal Finance;
5.6 (3) obtained a certification from the American Association of Family and Consumer
5.7 Sciences in personal and family financial education; or
5.8 (4) obtained a test-based certification in personal finance through Working in Support
5.9 of Education.
5.10 (d) A personal finance seal is valid for five years. The board must adopt rules requiring
5.11 a teacher to complete professional development in personal finance instruction equivalent
5.12 to one hour per year to renew the seal, and provide the board satisfactory evidence of
5.13 completing the additional preparation.
5.14 EFFECTIVE DATE. This section is effective the day following final enactment.
